Kloey Terms of Use

These Terms apply to your use of Kloey, an adults-only AI companion and mood-journaling app. The Kloey Privacy Policy explains how we handle your information and forms part of these Terms. Apple's Licensed Application End User License Agreement (Standard EULA) also applies to your use of the app. These Terms add to the Standard EULA. If the two conflict, the Standard EULA controls the licence to use the app, and these Terms control everything else.

1. Eligibility and your account

You must be at least 18 years old and legally able to accept these Terms. Kloey uses Apple's Declared Age Range where it is available. Otherwise, you confirm that you are an adult. Keep your sign-in details and your device secure. Contact contact@trykloey.com straight away if you think someone has accessed your account without permission.

2. The service

Kloey provides:

• AI chat with Kloey;
• daily mood check-ins;
• a personal journal with tags, activities and optional photos;
• voice-to-text journaling;
• breathing and reflection exercises;
• mood charts and week, month and year reports;
• weekly journal recaps you request;
• AI mood reflections you request;
• reminders and a Home Screen widget; and
• Premium features through auto-renewing weekly and yearly subscriptions.

Chat accepts text only. Voice transcription starts when you submit a recording. Recaps and mood reflections are created only when you request them.

We may change, add or remove features. Some features depend on third-party services and may be temporarily unavailable.

3. AI features and your permission

Kloey uses OpenAI for AI chat, safety checks of journal photos, weekly recaps you request and mood reflections you request. Kloey uses Meta's Model API for voice transcription. The Privacy Policy describes what each feature sends, why, and how long each provider keeps it.

Kloey sends your personal information to an AI provider only after you allow AI data sharing. This is a separate choice from accepting these Terms or the Privacy Policy. Accepting these Terms does not give that permission.

You can turn AI data sharing off at any time in Settings. If you do, Kloey stops sending information to these providers and the AI features are unavailable until you turn it on again. Turning it off does not recall information that has already been sent, and it does not remove records that a provider keeps under its own safety or legal rules.

4. Your content and AI output

You keep the rights you have in the journal entries, check-ins, photos, recordings and messages you submit. You give us a limited permission to receive, store, reproduce, process and transmit that content only so that we can operate, secure and support Kloey, provide the features you use, and meet legal obligations. This includes sharing content with the providers named in the Privacy Policy when you have allowed AI data sharing.

We do not sell your journal or chat content. We do not use it to train general-purpose AI models.

You are responsible for the content you submit and for having the rights needed to share it. AI output is created for your personal use. It may be inaccurate, incomplete or unsuitable for your situation. You decide whether to rely on it or share it.

5. Personal reflection, not professional care

Kloey is a companion and personal-reflection tool. It is not a person, clinician, therapy service, medical provider, diagnostic tool or emergency service. AI replies, recaps and reflections do not diagnose conditions, recommend treatment or replace qualified professional advice. If you are in immediate danger, contact your local emergency service. 6. Subscriptions and payments

Kloey offers weekly and yearly auto-renewing subscriptions through Apple In-App Purchase. Before you confirm a purchase, the app shows the plan, its length, its price and any introductory offer or free trial. Payment is charged to your Apple Account when you confirm the purchase.

Your subscription renews automatically at the price then in effect, unless you cancel before the renewal date shown by Apple. If you start a free trial or introductory offer and do not cancel before it ends, it converts to a paid subscription. You can manage or cancel your subscription in your Apple Account settings. On iPhone, go to Settings, tap your name, then tap Subscriptions.

Deleting your Kloey account does not cancel your Apple subscription. You can restore previous purchases in Kloey's settings using the Apple Account that made the purchase. Refund requests for App Store purchases must be made to Apple, under Apple's policies and the law that applies to you.

7. Privacy, export and account deletion

The Privacy Policy explains what Kloey and its providers collect, how we use and share it, and how long it is kept. You can download your data or delete your account in Settings. Account deletion is handled as described in the Privacy Policy.

8. Acceptable use

You may use Kloey only for lawful personal reflection. You must not:

• violate another person's rights;
• submit content you are not allowed to share;
• harass, threaten or abuse anyone;
• access another person's account;
• probe, disrupt or attack the service, or try to bypass its security or feature limits;
• reverse engineer the app, except where the law allows it; or
• use Kloey's output to train a competing AI model.

We may remove content or restrict access where this is reasonably necessary to protect users, the service or other people, or to comply with the law.

9. Changes, suspension and ending your use

We may update features or these Terms to maintain, improve, secure or lawfully operate Kloey. We will post the current version and give you notice of material changes. If a change affects how we share information with AI providers, we will ask for your permission again before that sharing begins.

We may restrict or suspend access where reasonably necessary to respond to unlawful use, harm to others, a security threat or a legal requirement. You can stop using Kloey at any time and delete your account in Settings.

10. Warranties and liability

Kloey is provided as it is and as it is available, to the extent the law allows. Nothing in these Terms removes or limits any right you have under consumer protection law where you live, or any liability that cannot be excluded by law.

11. Governing law and courts

These Terms are governed by the laws of the Kingdom of Morocco. This does not take away any mandatory consumer protection rights you have under the laws of the country where you live. Unless mandatory law gives you a different place to bring a claim, disputes are subject to the courts of Casablanca, Morocco.
